Terms and Conditions of Use

Aviiron, Société par Actions Simplifiée, (SIRET 909 450 975 000 26), hereinafter referred to as "the Company," is the publishing company of the website lost-cat.org, hereinafter referred to as "the Site."

The Site is hosted by OVH, 2 rue Kellermann, 59100 Roubaix, Nord, France.

These Terms and Conditions of Use apply only to content exclusively published by the Company on the Site. Excluded from their scope, and therefore not subject to these Terms and Conditions of Use, are contents published by a third party or in partnership with a third party, even if they appear under the Site's graphic charter, or are hosted by the Site or a technical host of the Site (for example, but not limited to: advertisement content, message content, third-party content in framing, content published under "white" or "grey" branding, hyperlinks redirecting to external sites, etc.).

The presence of third-party content on the Site or the ability to access such content from the Site does not constitute validation of these contents by the Company. The Company, therefore, cannot be held responsible for the information, opinions, recommendations, or services offered by these third parties, and the Company shall not be subject to claims, complaints, legal proceedings, or disputes concerning such content.

Also excluded from the scope of these Terms and Conditions of Use are advertising spaces and advertisements appearing on the Site.

Operation and Use of the Site

The Company provides no guarantee regarding the operation of the Site. The user expressly acknowledges that under no circumstances can the Company be held responsible for the consequences resulting from the modification, discontinuation, or deletion of the service, for any reason whatsoever, including technical constraints or limitations.

The Company is free to modify or delete the service at any time.

The user agrees not to upload or distribute on the Site any document, content, information, file, or any other data, in any form, that may restrict, slow down, disrupt, prevent, or interrupt the proper functioning and normal use of the Site, the Site's IT and/or telecommunications equipment, its service providers and partners, and other users of the Site.

Specifically, the user agrees:
- Not to use any malicious software (including but not limited to viruses, worms, trojans, dialers, spyware, etc.).
- Not to distribute spam and, more generally, not to use any bulk and/or automated messaging technique.
- Not to use any crawling or web scraping techniques, or any technique that enables the massive copying or downloading of Site content. The use of such a technique would be considered an act of counterfeiting that violates the Company's intellectual property rights.

To access certain features of the Site and benefit from certain services offered on the Site, including publishing advertisements or messages on advertisements, the user must provide personal data.

For this purpose, the user agrees to provide accurate, up-to-date, and complete information. The user must provide a valid email address.

Any entry of false, inaccurate, outdated, or incomplete information, or a username or pseudonym containing offensive, defamatory, violent, obscene, or otherwise inappropriate terms, may result in the suspension or closure of the user's account.

More generally, the Company reserves the right to suspend the publication of advertisements and messages or delete advertisements and messages from a malicious user or in case of violation of these Terms and Conditions of Use or violation of legal or regulatory provisions.

Advertisements and messages impersonating a third party or intended to publish messages under a third party's identity will be deleted. The Company also reserves the right to take action, including seeking legal recourse, in such cases. It is recalled that online identity theft using any identifying data (such as name, email address, or photograph) is a criminal offense under Article 226-4-1 of the Penal Code.

Moderation Policy

Volunteer moderators operate on the Site. They have access to information contained in advertisements and to a dedicated mailbox hello@lost-cat.org. They have the ability to remove a message or an advertisement from the Site. They may also, at the user's request, modify or delete an advertisement. Actions taken on the Site by moderators are their own responsibility and not that of the Company.

The user is responsible for the messages they post on the Site; they must comply with applicable legal and regulatory provisions, particularly those that penalize abuses of freedom of expression.

They must ensure their messages do not contain:
- Racist, xenophobic, anti-Semitic, homophobic, revisionist, pornographic, pedophilic, or pedopornographic statements.
- Insulting, defamatory statements, or those infringing on privacy and, more generally, on personality rights.
- Statements that undermine human dignity.
- Statements inciting violence, suicide, terrorism, the use, manufacture, or distribution of illicit substances.
- Statements inciting crimes or offenses or glorifying such acts, particularly crimes against humanity.
- Content violating third-party intellectual property rights (such as articles, books) for which they do not have the necessary permissions from authors and/or rights holders.
- Content promoting for-profit services.
- Content referring to esoteric animal search techniques: magnetizers, dowsers, fortune-telling, mediums, marabouts, telepathy, "animal communication," etc.
Links to such content are also prohibited.

This list is not exhaustive, and the user is informed that the Company or a moderator may freely delete any message containing statements violating legal or regulatory provisions or contrary to this policy. This possibility is in addition to the option, outlined in the previous section, of suspending or deleting all publications associated with an email address or IP address if necessary.

The user acknowledges that their published message is a simple message intended to assist a person who has lost or found an chat, and that as such, it is public, free of rights, and may be freely distributed, reused, or commented on. If a message is likely to be subject to intellectual property rights, particularly copyright, the user, by posting it, agrees to grant the Company a free license to all rights, including reproduction, representation, adaptation, translation, and distribution rights for the legal protection duration.

Intellectual Property

The Company holds all intellectual property rights on the Site and its content, including but not limited to graphic charters, titles, layouts, text, photographs, images, videos, and any other informational content.

The Company grants the user a simple, non-collective, non-exclusive right to use the content published on the Site.

Any commercial use of all or part of the Site's content is prohibited.

Personal Data

The personal data collected by the Company is limited to that voluntarily provided by the user when publishing an advertisement or message. This includes a pseudonym, possibly the user's name, and a valid email address. The only automatically collected data is the user's IP address.

Miscellaneous

By connecting to the Site, posting an advertisement or message, or subscribing to alerts, the user expressly and unreservedly accepts these Terms and Conditions of Use.

Any dispute relating to the validity, interpretation, or execution of these General Terms of Use shall be submitted to the competent French courts.

The Company reserves the right to modify these General Terms of Use at any time. The General Terms of Use are available on the Website at all times and can be printed. The Company therefore encourages the user to regularly review the General Terms of Use.
